Fernley city debate on Wednesday, Thursday

YERINGTON - Lyon County commissioners on Thursday are scheduled to issue an opinion on the feasibility of Fernley becoming a city and set a date on which Fernley residents will vote on the issue.

This next step in the lengthy incorporation process depends on a public hearing coming to a conclusion Wednesday's in Fernley. The May 30 hearing was continued when residents raised questions regarding possible costs of incorporation.

Once the public hearing process is completed, the county commissioners have 30 days to issue an opinion and designate an election date. The election must be held no earlier than 60 days or more than 120 days after the commission issues its opinion.

The vote may take place in a specially scheduled election or placed on the November ballot. If the issue is to be placed on November's general election ballot, the question must be prepared and submitted to the state no later than July 17.

Other agenda items include:

-- Amendments to the county's ordinance governing wasting of water. If approved, enforcement would bring the possibility of criminal sanctions through the issuance of citations by the sheriff's office. Any penalties would be considered a misdemeanor.

If a citation is issued, the court could order restitution for the cost of the wasted water or damage to the water system. Fines would include: First violation - $25; second violation - $50; third violation - $250; fourth violation - $500; successive violations - $1,000.
