District Attorney Noel Waters said Friday his office will review the facts of a fatal accident to determine if charges will be brought against the driver at fault.
About 5:30 p.m. Thursday, Dale Hoover, 54, of Dayton, driving a GMC pickup truck, failed to yield while exiting the driveway of Kathy's Someplace Else on Highway 50 East and crossed into the path of a westbound 1969 Harley-Davidson motorcycle driven by an unidentified Gardnerville man, according to the Nevada Highway Patrol.
The motorcyclist was thrown from the bike and pronounced dead at Carson-Tahoe Hospital about an hour later. His identity is being withheld pending notification of next of kin.
Waters said officers on the scene didn't believe they had sufficient evidence at the time to arrest Hoover.
"Their investigation is ongoing and it will be submitted to us on whether any charges ought to be filed," he said.
Trooper Todd Hartline said Hoover was given a breath test at the accident scene and recorded a blood-alcohol level well under the state's .08 limit.
