A man awaiting trial in the sexual assault of a 9-year-old girl was released from jail without bail Tuesday while both sides investigate new information.
District Judge Michael Griffin agreed to the release following a closed hearing detailing the newly discovered facts.
Griffin ordered Timothy Foreman, 37, to stay away from the victim and her family.
"If any inappropriate action occurs, you'll be back in jail with no bail," he admonished.
According to court records, the victim's mother allegedly walked in during one of the assaults. When the family confronted Foreman with the accusations Sept.14, he allegedly fled the area, failing to report for work the following day.
On Sept. 15, Carson City police issued a statement saying Foreman was wanted for questioning.
Accompanied by his attorney, Foreman turned himself in to the Carson City Sheriff's Department Sept. 19.
