A middle school history teacher will be tried Dec. 20 for allegedly exposing himself to an elderly neighbor.

The court date was set Tuesday during a district court arraignment in which Scott Frank, 26, pleaded not guilty to charges of open and gross lewdness and indecent exposure.

Frank, on administrative leave from his position at Carson Middle School, was arrested Aug. 1 after a neighbor called police July 29 claiming she could see, from an upstairs window in her home, Frank fondling himself in his back yard while watching his elderly neighbor.

The witness told police she allegedly saw Frank, nude from the waist down, approach the fence and call his neighbor over.

The victim also told police when Frank spoke to her, he was not wearing pants.

According to the arrest report, Frank allegedly said he didn't think anyone could see him in his back yard.

If convicted he faces the loss of his teaching license and could be subjected to registering as a sex offender.
