A hearing is today for a 22-year-old Gardnerville Ranchos man arrested early Saturday after a fight in front of a bar.
Deputies investigating the incident recognized Daniel Delgadillo sitting outside the bar and exhibiting symptoms of being under the influence.
A preliminary breath test determined his alcohol content at .205, more than twice the legal limit of .08 for driving.
Even though Delgadillo was not driving, he was in violation of terms of his probation in the 2010 traffic death of Michael Lombardo.
Delgadillo told deputies he thought he was off probation, but court documents indicate his probation is in effect until March 2013.
Delgadillo received a suspended 180-day sentence on a single count of vehicle manslaughter in the June 5, 2010, death of 24-year-old Lombardo.
Six months later, Delgadillo was arrested for driving under the influence with a blood-alcohol content of .240, three times the legal limit.
In May, Delgadillo was ordered to serve 30 days in Douglas County Jail before he was eligible for release to an in-patient substance abuse treatment center in Reno.
Time in the treatment center was to be counted against Delgadillo's sentence.
