Carson man gets jail for sex with girl

A Carson City man was sentenced Monday to six months in jail and at least two years of probation for having sex with a girl who was 14 years old.

Enrique Lopez Aguilar was 23 when he was arrested in October. The girl's father blocked his car in the driveway when she was being dropped off, according to the arrest report. Aguilar was originally charged with felony statutory sexual seduction. He pleaded guilty to unlawful contact with a child, a gross misdemeanor.

"If she had told me her real age, I never would have been in that situation," Aguilar told Judge James T. Russell before he was sentenced.

The girl reportedly told him she was 18 - but using that as a defense was "trying to blame the victim," prosecutor Gerald J. Gardner said.

"What the victim's issue is, is that she is 14 years old," he said.

Russell said he took both sides into consideration before sentencing and noted that he did not ban Aguilar from contact with minors altogether.

"I think you are a victim to some extent," Russell said from the bench. "... But you have to be responsible for your actions."
