Carson City man bound over on sexual assault against a minor under 14 charges

A 58-year-old Carson City man accused of sexually assaulting a boy who was 14 at the time, was bound over to district court Thursday morning.

Justice of the Peace Tom Armstrong said there was enough evidence to bind David Stone over on counts of sexual assault against a child under 14.

Stone was arrested on the sexual assault warrant on Feb. 11.

The victim testified Stone was supposed to take him to the Nevada Day Parade in 2011 and that he spent the preceding Thursday and Friday nights at Stone’s house. Stone told the boy he was sleeping in the bed with him. Stone massaged the boy’s back and then started touching him, the victim said.

“He put his hands on me. I asked him to stop but he wouldn’t stop,” the victim testified.

Stone began to take the boy’s clothes off, and then his own, before he molested him, he testified.

When the boy tried to leave, Stone blocked the way. The next night, a Friday, he molested the boy again, the victim testified.

The following Sunday evening, the boy told his father what had happened the two nights, he testified.

Carson City Sheriff’s Det. Salvador Acosta testified Stone gave detectives consent to search his house and offered a DNA sample, one of which also was taken from the victim.

Stone will be arraigned in district court, department one, at 9 a.m. May 6.

Stone’s defense attorney, Robert Grayson, asked the judge to consider lifting one of the conditions of his bail: an ankle bracelet. The bracelet is a financial burden, Grayson said.

Armstrong held up his fingers, almost pinched together, and said, “I’m this close to revoking his bail” following the boy’s testimony and Acosta’s testimony.
