Attorney General Adam Laxalt is appealing to the Nevada Supreme Court after a judge put a new school choice program on hold indefinitely.
Laxalt filed a notice of appeal on Friday, saying a speedy ruling from the high court could give clarity to thousands of families who applied to the Education Savings Account program and expected funds starting in February.
The voucher-style program allows parents to claim more than $5,000 in state per-pupil school funds each year and use it for qualified education expenses.
Opponents argue the Republican-backed program unconstitutionally diverts money from public schools.
Carson City District Court Judge James Wilson granted a preliminary injunction Monday that orders the state treasurer to stop implementing the program pending further court deliberations.
Laxalt wants the injunction overturned.
