Appeal filed against North Carson City Bodines permit

A group of gaming properties is appealing a special use permit approved for a new Bodines casino in north Carson City.

Garrett Gordon with Lewis Roca Rothberger Christie LLP, representing Carson Nugget Casino Hotel, Casino Fandango, Gold Dust West Casino Hotel, Carson City Max Casino and SlotWorld Casino, filed an appeal that will be heard Thursday at the Board of Supervisors meeting.

Gordon spoke on behalf of the group at the Sept. 28 Planning Commission meeting where Silver Bullet of Nevada, LLC was granted the SUP to operate an unlimited gaming casino, bar, and additional signage, at 3246 N. Carson St. in NorthTown Plaza.

In his appeal, Gordon says Bodines doesn’t meet certain goals outlined in the master plan, including concentrating gaming operations in the downtown core and on casinos that attract visitors to the city.

He also says the Horseshoe Club’s gaming license, which Bodines is in the process of acquiring to operate the new casino, is no longer in good standing so the transfer of it to Bodines shouldn’t be approved.

The license was grandfathered in before changes made to the municipal code, which would allow Bodines to operate a casino without the 100 hotel rooms required for new licenses.

The transfer of the license has to be approved by both the Nevada Gaming Control Board and Gaming Commission, and the Board of Supervisors.

Also on the supervisors agenda are a few items relating to plans to install energy-saving equipment in some city properties.

The board will vote to confirm Sherman & Howard as bond counsel in issuing Qualified Energy Conservation Bonds in a maximum amount of $3.1 million and the tax-exempt bonds in the maximum amount of $1.2 million to finance the projects.

The supervisors will also hear a first reading of an ordinance to authorize the bonds and a resolution creating a Green Community Program in connection with the conservation bonds.

In 2015, the board approved a contract with Ameresco, Inc. to perform a financial grade energy audit, which identified the projects.

The board will also vote whether to adopt on second reading an ordinance that would amend municipal code on motorcycle violations to include four-wheel off-road vehicles, which would prohibit driving the ATVs within 500 feet of residences except for snow plowing and weed abatement.

The supervisors also will vote on whether to enter into partnership agreement with Northern Nevada Development Authority for a Brownfields Assessment Program and apply for a $600,000 grant.

The grant would be administered by NNDA and be used to find suitable properties for the manufacturing Certified Sites program.
